In the present petition under Section 482 Cr.PC he is seeking a direction for protection from harassment and demand of illegal gratification at the hands of respondents 4 to 6 i.e. ASI Kulwant Singh, PS CIA Staff,Amritsar, Davinder Singh,Head Constable and Sheela,Head Constable, PS CIA Staff,Amritsar. Upon notice reply by way of affidavit of Harjit Singh,PPS, Assistant Commissioner of Police, Crime, Amritsar has been filed on behalf of respondents 1 to 3.
A perusal of the same reveals that the petitioner stands convicted vide judgment dated 3.2.2007 passed by JMIC Amritsar for offences under the Gambling Act as well as Section 420 IPC. CRM-M 26696/2015 reveals that the petitioner and his agents are engaged in operating racket of "Darra Satta" i.e. gambling by digit numbers. It is further stated that an FIR No.177 dated 24.7.2015 under Sections 13-A/3/67 of Gambling Act at PS Chheharta,Amritsar stands registered against him. At the time of hearing learned counsel for the petitioner disputes certain facts mentioned in the aforesaid reply and therefore, seeks permission of the Court to withdraw the present petition to pursue his remedy in accordance with law.
Dismissed as withdrawn with liberty aforesaid. 31.08.2015.
