The petitioner apprehending arrest in the FIR captioned above, has come up before this Court second time, under Section 438 CrPC seeking bail by filing the present petition. 2.

Counsel for the State opposes the present petition and submits that the present bail petition is not maintainable for the reason that first bail petition was dismissed on merits. 3.

After arguing for some time and facing the strict opposition from the State, petitioner's counsel seeks withdrawal of the present petition. 4.

Given above, petition is disposed of as withdrawn. It is clarified that petitioner shall be at liberty to file regular bail petition before this court after surrender. It is further clarified that in case, petitioner surrenders and files regular bail petition, then filing and withdrawal of the present petition shall not come in the way and power of attorney filed in the present case shall suffice and there shall be no need to file fresh power of attorney in the fresh petition, if filed and Registry shall not raise any objection.
