(ORAL) Petitioner-Tej Singh Dhillon, has filed the instant petition under Section 482 of the Code of Criminal Procedure (for short `the Cr.P.C.'), seeking directions to the respondents to take appropriate legal action by conducting fair and thorough investigation/inquiry in case FIR No.64 dated 20.05.2022, under Sections 420, 473, 467, 468, 471 and 120 of the Indian Penal Code, registered at Police Station Raman, District Bathinda, and also to file status report in the present matter. 2.

Briefly, the afore-said case FIR was registered on the complaint of the petitioner (Tej Singh Dhillon), wherein he had stated that he was in transport business and had purchased one vehicle (Trailer) Model 4018 bearing No.PB-03U-8803 having Chassis No.MAT44720892H11754 Engine No.90H82778350, in the year 2009. It was alleged that the complainant learnt that some other person was driving the Ghora (Trailer) in the refinery, Bathinda with the fake documents and fake number on his

own Trailer and upon verification, it was revealed that the said Trailer belongs to Gurpreet Singh son of Jangir Singh resident of Sheikhpura, who was running a company in the name of `Maan Transport'. It was alleged that Gurpreet Singh was working in the refinery by putting fake engine number, chassis number and fake number of his Trailer by preparing fake documents. Accordingly, legal action was sought to be taken against the accused person.

Pursuant to the advance copy of the petition having been served upon learned State counsel, Mr. H.S. Sidhu, Assistant Advocate General, Punjab, appears and files a short reply by way of an affidavit of Sh. Butta Singh Gill, PPS, Deputy Superintendent of Police, Talwandi Sabo, Sub-Division, Bathinda, on behalf of the respondents, which is taken on record, subject to all just exceptions. A copy, thereof, has been supplied to learned counsel for the petitioner.

In the reply filed by learned State counsel in the Court today, it has been stated as under :- "5.

After registration of FIR in question, the investigation was carried out. During the course of investigation the accused Gurpreet Singh's vehicle Ghora (Trailor) was taken into police possession alongwith fake Registration No.PB-03U-8803, Chassis No.MAT44720892H11754 and Engine No.90H82778350 alongwith documents such as gate pass of, Log book of Maan Transport from Gurvinder Singh s/o Sewa Singh. Gurvinder Singh told that he was working as Store incharge of Fernance Febrica India Ltd. and the company had hired the above said vehicle from Gurpreet Singh. 6.

The Investigating officer obtained documentary record from Regional Transport Authority, Bathinda with regard to the vehicle registration No.PB-

03U-8803 and from the report it was surfaced that the above said Registration No.PB-03U-8803 was issued to the petitioner's vehicle. It was also transpired that the accused had affixed fake number plate on his vehicle. Resultantly, Sections 467, 468, 471, 120-B IPC was added through DDR No.37 dated 24.05.2022.

That during the course of investigation, the police party conducted raids to nab the accused on 24.05.2022, 16.06.2022, 15.07.2022, 07.10.2022, 28.02.2023, 10.03.2023, 24.03.2023, 09.04.2023, 27.04.2023, 04.05.2023, 10.05.2023 and 11.05.2023 at various expected places.

That so far as matter of representation Annexure P-3 and Annexure P-4 are concerned, the same were thoroughly inquired and finding no ground in the said representations. The same were disposed off, as the investigation is under progress and the efforts are being made to nab the accused."

A perusal of the aforesaid reply would reveal that in pursuance of the FIR got registered by the petitioner, the police has taken action and the investigation is stated to be under progress and the efforts are being made to nab the accused.

In view of the above, no further orders are required to be passed in the instant case. However, it is expected that necessary action in the aforesaid case FIR shall be taken against the accused. 7.
