ALKA SARIN, J. (ORAL) 1.

The present appeal pertains to the year 1996. Vide order dated 17.11.2023 notices were issued to the appellants as well as respondents. As per the service report, appellant Nos.1 to 8 remain unserved with the report that they were not found residing at the given address and shifted to another place. There is no other address available with the Court for effecting service of the appellants except the one mentioned in the memo of parties and in the judgments and decrees passed by the Trial Court and the First Appellate Court and is the same on which the notice was sent. Respondent No.1 has died. Notice issued to respondent No.2 has not been received back either served or otherwise. It appears that the appellants are not interested in pursuing the present appeal.

In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution. 3.

Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
