(Oral) The petitioner prays for grant of anticipatory bail in FIR No.227 dated 08.11.2017, registered under Sections 419, 420, 467, 468, 471 and 120-B of the Indian Penal Code (in short 'IPC') at Police Station Sector 53, Gurugram, District Gurugram. The operative part of the order dated 24.07.2018, vide which interim anticipatory bail has been granted to the petitioner, is reproduced as under:- "....Learned State counse, on instructions from ASI Jaswant Singh, submits that role of the petitioner is that he attested an earlier agreement to sell as a witness and he be directed to join the investigation.
List again on 14.11.2018...."
Counsel for the petitioner submits that in pursuance to the order dated 24.07.2018, the petitioner has appeared before the Investigating Officer and has joined the investigation and the allegations against him are that he attested an earlier agreement to sell MOHD YAKUB 2018.11.14 16:41 I attest to the accuracy and authenticity of this document High Court, Chandigarh
CRM-M No.27710 of 2018 as a witness and is not a beneficiary, in any manner. Counsel for the State, on instructions from ASI Kanwar Pal Singh, assisted by counsel for the complainant has not disputed the factual position and submits that the petitioner is no more required for further investigation.
In view of the above, this petition is allowed and the interim bail granted to the petitioner vide order dated 24.07.2018 is made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C.
