(ORAL) This is a petition that has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case FIR No. 49 dated 28.06.2017 under Sections 498-A, 406, 323, 324, 506, and 34 IPC later on 326 IPC added, registered at Police Station Saran Kahnuwan, District Gurdaspur.

Learned counsel for the petitioner contends that during the pendency of the proceedings before this Court, the matter was referred to the Mediation and Conciliation Centre and with the able assistance of the Mediator, an amicable solution has been arrived at between the parties by settlement agreement dated 06.11.2017.

CRM-M-26807-2017 -2In view of the fact that the matter stands settled amicably between the parties, the petition is allowed and interim order dated 01.08.2017, granting interim bail to the petitioner, is hereby made absolute subject to the condition that the petitioner will not tamper with evidence or hamper the investigation; will not leave India without permission of the Court and will comply with the conditions contained in Section 438(2) Cr.P.C.
