(ORAL) This appeal has been filed by the appellant/plaintiff for setting aside the judgment dated 17.10.2018 passed by the Trial Court, whereby the suit of the appellant/plaintiff has been rejected on an application under Order 7 Rule 11 CPC filed by respondent No.4-Bank; and the judgment and decree dated 28.02.2019 passed by the Appellate Court, whereby appeal filed by the appellant/plaintiff has also been dismissed, upholding the judgment and decree passed by the trial Court.

Learned counsel for the appellant seeks permission to withdraw the present appeal in view of the decision rendered by Hon'ble the Supreme Court on 21.01.2022 passed in SLP(C) No.9059 of 2018 titled as 'Madan Mohan Vs. Kamal Parkash Goya and others'.
