(ORAL) Prayer in the instant petition under Section 438 Cr.P.C. has been made for grant of pre-arrest bail to petitioner - Resham Singh in case FIR No.61 dated 10.07.2017 (Annexure P-1) under Sections 379, 411, 420, 473 IPC registered at Police Station Kot Dharmu, District Mansa. Allegations against the petitioner are that he along with his coaccused Gurjant Singh has stolen a motorcycle and agricultural equipments from various places. After registration of the case, Gurjant Singh coaccused of the petitioner was arrested, who, in his disclosure statement, stated that, in fact, petitioner had given him the stolen motorcycle for sale which was recovered from him with a forged number plate.
Learned counsel for the petitioner contends that the petitioner has been falsely implicated. No other case is pending against the petitioner except the present one. Disclosure statement of Gurjant Singh against the petitioner is a very weak type of evidence. Nothing has to be recovered from him.

-2CRM-M-26831 of 2017 (O&M) In view of the totality of the facts and circumstances of the case, petitioner does not deserve the concession of pre-arrest bail as his custodial interrogation is very much needed to recover various other stolen articles, more particularly, when co-accused Gurjant Singh has named him who is in custody.
