M.M.S. BEDI, J (ORAL) Petitioners claim to be vandees from the co-sharers of private respondent No.5. A civil suit has been filed by respondent No.5 against the petitioners for permanent injunction. The petitioners claim that they are in actual physical possession and in connivance with police officials respondent No.5 seeks to interfere in the possession of the petitioners.

Without expression of any opinion regarding the controversy of possession between the petitioners and respondent No.5, I am of the considered opinion that in case there is any threat to the life and liberty of a human being or there is chance of breach of piece on account of controversy of possession, the concerned police authorities must take care of the same. Petitioner No.2 appears to have filed a representation Annexure P5 to the DGP, Punjab and Annexure P7, to the Senior Superintendent of Police,

CRM-M-26810-2015 (O&M) Batala.

Notice of motion to the Advocate General, Punjab . On asking of the Court, notice has been accepted by Mr.S.S.Chandumajra, DAG., Punjab, present in the Court. Copy supplied.

This petition is disposed of with a direction that the Senior Superintendent of Police, Batala would look into the representation and in case the allegations are found to be correct necessary steps would be taken for ensuring that life and liberty of the any of the parties is not infringed. If the allegations are found to be incorrect, it will be open to the Senior Superintendent of Police, Batala, to drop the matter leaving the parties to avail appropriate legal remedy in the Court of law.
