RAMENDRA JAIN, J. (ORAL) The case has been taken up for hearing through video conferencing.
Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner - Dhiraj Kumar @ Dhira - in a case arising from FIR No.147 dated 06.12.2019 registered under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (Section 29 of the NDPS Act added later on) at Police Station Longowal. According to the prosecution, on 06.12.2019 three persons, namely, Dhiraj Kumar @ Dhira (petitioner herein), Pankaj Garg alias Nannu and Amandeep Singh alias Amna were apprehended with conscious possession of 50, 800 and 1250 intoxicant injections, respectively, without any permit or licence.

-2CRM-M-14205 of 2020 (O&M) lift on the scooter of his co-accused half kilometer prior to the alleged place of apprehension. Even the scooter on which petitioner was travelling does not belong to him. Petitioner has falsely been implicated. He is in custody since 06.12.2019. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioner in jail any more. On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner submitting that petitioner was apprehended at the spot with drug without any permit or licence. Therefore, there is no question of his false implication. Considering heavy recovery of intoxicant injections, this Court is not inclined to grant regular bail to the petitioner. Dismissed.
