Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner - HC Paramjit Kumar - in a case arising from FIR No.46 dated 01.02.2020 registered under Sections 420, 465, 467, 468, 471, 120-B IPC at Police Station Civil Lines, District Amritsar.

According to the prosecution, petitioner, who is a Head Constable in the Punjab Police, along with his wife cheated and defrauded the complainant for `28.00 lakh by entering into an agreement for sale of his house, which was already under mortgage with the bank. Heard.

-2CRM-M-14237 of 2020 case under Section 376 IPC, besides booked in four similar cases of fraud, out of which, according to learned counsel for the petitioner, in one case, petitioner has compromised. Thus, considering criminal antecedents of the petitioner and that he is an habitual defrauder, this Court is not inclined to grant regular bail to him.

At this stage, learned counsel for the petitioner prays that he may be permitted to withdraw this petition.
