Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.81 dated 18.05.2015 under Sections 365, 302, 201 and 34 IPC, registered at Police Station Division No.7, Jalandhar.
Notice of motion.
On asking of the Court, Mr.Deep Singh, Asstt. Advocate General, Punjab who is present in the Court, accepted notice on behalf of the respondent-State and contested the petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that as per allegations of the prosecution, complainant's brother Ranjit Singh Pawar came from England Vineet Gulati 2017.02.09 17:16 I attest to the accuracy and authenticity of this document Chandigarh to Amritsar on 08.05.2015 and to bring him, Baldev Singh Deol had gone,
CRM No.M-27729 of 2016 -2who had already came to India but till date, the brother of the complainant did not come to him and the complainant made many efforts but nothing could be known.
During the investigation, the present petitioner has been nominated. As per the prosecution version, there is circumstantial evidence connecting the accused-petitioner with the crime. The challan has already been presented and charges have already been made. Three private witnesses have also been examined.
Keeping in view the facts and circumstances of the present case and in view of the nature and gravity of the offence, I do not find it a fit case where petitioner is entitled to benefit of regular bail. Therefore, finding no merit in the present petition, the same dismissed.
