Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.95 dated 05.05.2016 under Sections 406 and 420 IPC, registered at Police Station Division No.7, Jalandhar.
I have heard learned counsel for the petitioner and have gone through the record.
As per the allegations in the FIR, Rekha Rani, sister of Mandeep Chand is residing in Cyprus and is doing the work of sending the people abroad. She demanded a sum of `6 lacs and told the complainant to give the money to his brother Mandeep Chand and mother, who are residing at village Sikandarpura, District Jalandhar. It is also the allegation in the FIR that `6 lacs was given to present petitioner but the complainant was Vineet Gulati 2016.08.12 15:46 I attest to the accuracy and authenticity of this document Chandigarh neither sent to abroad nor money was returned.
CRM No.M-27731 of 2016 -2Keeping in view the facts and circumstances of the present case, nature and gravity of the offence and in view of the fact that the petitioner is required for custodial interrogation, I do not find it a fit case where petitioner is entitled to benefit of anticipatory bail. Therefore, finding no merit in the present petition, the same is dismissed.
