RAMENDRA JAIN, J. (ORAL) The case has been taken up for hearing through video conferencing.

Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner - Jaswant Singh - in a case arising from FIR No.336 dated 27.11.2014 registered under Sections 450, 325, 324, 323, 34 IPC at Police Station Dharamkot, District Moga. According to the prosecution, on 25.11.2014, petitioner accompanying his sister Sukhwinder Kaur and six/seven more persons armed with sharp edged deadly weapons trespassed house of the complainant party and caused grievous injuries. Petitioner has been attributed grievous injuries, but police has not filed challan under Section 326 IPC.

-2CRM-M-14218 of 2020 been implicated to settle a family dispute. Final report under Section 173(2) Cr.P.C. was filed in the absence of petitioner as he was away for two years to Calcutta to earn his livelihood. Petitioner was illegally got declared offender on 24.05.2018 in his absence. Due to Covid-19, petitioner came to his permanent abode in Punjab and was arrested on 17.04.2019. Since then he is in custody. No recovery has to be effected from the petitioner. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioner in jail any more. On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner submitting that for two years, petitioner remained absconding and thus was declared proclaimed offender. He was arrested on 17.04.2019. In case, petitioner is granted regular bail, he will misuse the same.

At this stage, learned counsel for the petitioner prays that he may be allowed to withdraw this petition.
