The petitioner prays for grant of pre-arrest bail in a criminal case arising out from FIR No. 55 dated 12.05.2020, registered under Section 148, 149, 188, 323, 324, 447, 506 & 511 IPC at Police Station Kunjpura, District Karnal.
On 11.06.2020, the following order was passed:- "The petitioner prays for grant of pre-arrest bail in a criminal case arising out from FIR No.55, dated 12.05.2020, registered under Sections 148/149/188/323/324/447/506/511 IPC, at Police Station Kunjpura, District Karnal.
In a nutshell, the case of the prosecution is that on account of dispute with regard to demarcation of the agricultural land and its boundary, the owners of the adjoining DEEPAK KUMAR BHARDWAJ 2020.06.17 14:38 I attest to the accuracy and integrity of this document
Criminal Misc. No. M-14291 of 2020 land entered into a scuffle. The petitioner is 73 years old. He is shown to be, no doubt, present at the time of scuffle but he is not alleged to have played active role.
Hearing of the case was held through video conferencing on account of restricted functioning of the Courts. Notice of motion for 16.06.2020.
On asking of this court, Mr. Deepak Sabharwal, Additional Advocate General, Haryana, accepts notice on behalf of the State.
In the meantime, in the event of arrest, the petitioner shall be released on interim bail subject to furnishing personal bonds and surety to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438(2) Cr.P.C."
Mr. Sabharwal, on instructions from Inspector Gaurav, has submitted that the petitioner has joined investigation, co-operated and not required for further custodial interrogation. Keeping in view the aforesaid facts, interim bail granted to the petitioner on 11.06.2020 is made absolute.
