Petition is taken up for final disposal in view of the short controversy involved. By order dated 13.03.2013, the petitioner who was already on bail was absent on the appointed date. The trial Court, therefore, cancelled his bail, forfeited bail bonds and he was declared proclaimed offender. The petitioner has now approached this Court for stay of the order dated 06.01.2014, by which he was declared proclaimed offender. The explanation tendered by learned counsel for the petitioner is that the petitioner had fallen down from the building and suffered severe injuries on head. For that purpose he has invited my attention to the documentary evidence which I have seen. I am satisfied that the petitioner was really disabled from attending the Court. CRM-M-27741-2016 [2] the petitioner was seriously injured. The trial is still pending, the petitioner is stated to be the only accused in the trial. In that view of the matter, by way of one opportunity the petitioner deserves to allowed to be on bail to face the trial. Consequently the order dated 06.01.2014 is quashed in FIR No.104 dated 02.05.2011 registered under Sections 382 and 34 of Indian Penal Code, 1860, at police station Division No.5, District Ludhiana, by which the petitioner was declared as proclaimed offender. In the result, the petition is allowed. The petitioner to appear before the trial Court with promptitude. The trial be expedited.
