Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in complaint case No.30023 dated 08.02.2012 titled as 'M/s Sarvotam Leasing and Real Estates Ltd. vs. Sukhjeet Bedi' under Section 138 of the Negotiable Instruments Act, 1881.
I have heard learned counsel for the petitioner and have gone through the record.
From the record, I find that the petitioner was appearing in complaint case under Section 138 of the Negotiable Instruments Act. As per the arguments of learned counsel for the petitioner, the petitioner absented from the proceedings on 17.10.2014. When the matter was fixed for defence evidence, then he did not appear before the Court and was declared proclaimed person under Section 82 VINEET GULATI 2015.08.14 16:15 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-26842 of 2015 -2Cr.P.C. The complaint is pending since February 2011. It is clear from the order dated 04.08.2015 passed by learned Addl. Sessions Judge, Jalandhar that petitioner is misusing the concession of bail and further no cogent ground has been given for such a long absence. Keeping in view the above discussion, I do not find it a fit case where petitioner is entitled to grant of anticipatory bail. Therefore, finding no merit in the present petition, the same is dismissed.
