Petitioner Rakesh Kumar, working as Forester, Saha Block, Saha Range, resident of VPO Pathreri, Tehsil Naraingarh, District Ambala, Haryana, feeling aggrieved by order dated 26.5.2020 issued by respondent No.3 Chief Conservator of Forest, North Circle Ambala, Forest Complex, Company Bagh, Vikas Vihar, Ambala City, transferring him from Forest Range Saha (Saha Block) to Ambala Range, has brought the present writ petition before this Court, challenging the order in question being without jurisdiction, unconstitutional and in violation of instructions of Government of Haryana etc. and prayed that the same be quashed. CWP No. 7796 of 2020 -2I have heard learned counsel for the petitioner besides going through the case file.

The petitioner has approached this Court directly without first availing of the departmental remedy in the form of submitting representation to the competent authority, craving for withdrawal of the order in question and cancellation of his transfer. It would be proper and appropriate, if the matter is dealt with at departmental level first, so as to afford the opportunity to the concerned Officer to consider the grievances of the petitioner and if some merit is found therein to take a remedial measure in that regard. With the above observations, the present writ petition is disposed of with a direction to the petitioner to move a representation before the competent authority, which shall be decided within two months from the date of receipt thereof.

In case the petitioner is not satisfied with the order passed and still nurses any grievance, then he may approach the Court again in accordance with law.
