HARSIMRAN SINGH SETHI J. (ORAL) Learned counsel for the petitioners argues that in the present case the petitioners retired from service starting from December, 2020 till April 2021 but their pensionary benefits have either been released after inordinate delay or are still pending for release by the respondents and, therefore, the respondent-University is liable to be directed to release all pensionary benefits to the petitioners along with interest keeping in view the judgment of the Full Bench of this Court in A.S. Randhawa Vs. State of Punjab and others, 1997(3) SCT 468.

Learned counsel for the petitioners submits that the grievance which has been raised by the petitioners in the present petition has already been raised by them in their legal notice dated 04.04.2022 (Annexure P-3) SATYAWAN 2022.04.26 15:59 I attest to the accuracy and authenticity of this document

CWP-8287-2022 which is still pending consideration with the respondents and the petitioners will be satisfied at this stage if a time bond direction is given to the respondents to decide the same by passing appropriate speaking order. Notice of motion.

Mr. Harchand Singh Batth, Advocate who is present in the Court, accepts notice on behalf of the respondents. Learned counsel for the respondents raises no objection qua deciding the legal notice dated 04.04.2022 (Annexure P-3) in a time bound manner by passing an appropriate speaking order. Without commenting upon the merits of the case or the claim raised by the petitioners in the said legal notice dated 04.04.2022 (Annexure P-3), the present writ petition is disposed of with a direction to the respondent No.4 to decide the legal notice dated 04.04.2022 (Annexure P-3) by passing appropriate speaking order within a period of eight weeks from the receipt of copy of this order.

In case after deciding the legal notice, the petitoners are found entitled for any relief as claimed, the same be also released to them within a period of four weeks thereafter.
