The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.124 dated 3.9.2014 registered for the offences under Sections 21 and 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as `the Act') at Police Station Bhogpur, District Jalandhar.

Notice of motion to Advocate General, Punjab. On the asking of the Court, Ms. Shivali, learned Assistant Advocate General, Punjab has put in appearance and accepted notice on behalf of the respondent-State and contested this petition. I have heard learned counsel for the petitioner and learned Assistant Advocate General, Punjab appearing for the respondent-State and have gone through the record.

From the record, I find that the present petitioner, who was Harpal Singh Parmar 2016.08.12 14:16 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-27768 of 2016 [2] already on bail, has absented from the Court proceedings and his nonbailable warrants have been issued for 8.9.2016. Learned counsel for the petitioner argued that the absence of the petitioner from the Court proceedings is not intentional. Keeping in view the facts and circumstances of the present case, I find that no purpose will be served by sending the petitioner to custody. The trial of the case will take long time. Therefore, in view of the above, this petition is allowed and the petitioner is directed to appear before the trial Court within ten days from today and if he appears within the above stated time, then the trial Court will release him on bail subject to its satisfaction. If the petitioner does not appear within ten days before the Court, then this petition will be treated as dismissed.
