This petition has been filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No.86 dated 23.2.2016 registered for the offences under Sections 379-B, 427, 452 and 201 IPC at Police Station Kundli, District Sonipat.

Notice of motion to Advocate General, Haryana. Mr. Vikas Chopra, learned Deputy Advocate General, Haryana has put in appearance on behalf of the respondent-State and contested this petition.

Cr. Misc. No.M-27779 of 2016 [2] As per the FIR, which was got registered by Amit Kumar on 21.2.2016, he came to know at about 3.30 p.m. that some unknown persons after entering into his shop, broken LED installed in the shop and broken furniture and glasses and also robbed 500-700 rupees kept in the drawer. The petitioner has been in custody since 29.2.2016. He is no more required for any interrogation and investigation purposes. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the final disposal of the case. Therefore, keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, this criminal miscellaneous petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal bond in the sum of `35,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
