The present appeal pertains to the year 1996. Vide order dated 06.12.2023 notices were issued to the parties. 2.

As per the Office report, notice issued to appellant No.1 has been received back unserved due to incomplete address. Appellant No.2 and respondents No.1(a) and 1(b) are stated to have died. Notice issued to respondent No.1(c) has been received back duly served, however, no one has appeared on behalf of respondent No.1(c). No one has appeared on behalf of legal heirs of appellant No.2 and respondents No.1(a) and 1(b) either. There is no other address available with the Court for effecting service of appellant No.1 except the one mentioned in the memo of parties and in the judgments and decrees passed by the Trial Court and the First Appellate Court and is the same on which the notice was sent.

In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution. AMAN JAIN 2024.04.02 21:25 I attest to the accuracy and integrity of this judgment/order.
