The offence under Section 138 of the Negotiable Instruments Act, 1881, is distinct from an offence under Indian Penal Code. Therefore, both the complaint case under Section 138 of the Negotiable Instruments Act, 1881 and FIR case under IPC , may be on similar set of allegations, cannot be clubbed together.

Dismissed.
