H. S. Madaan, J. (Oral) Learned counsel for the petitioners states that he be permitted to withdraw the present petition. However he has requested that since the petitioners are old persons, some order, granting them exemption from personal appearing in the trial Court, be passed. The petition is dismissed as withdrawn.
However, a direction is issued to the trial Court that on an application being filed by the petitioners, their personal appearance be exempted subject to an undertaking by their counsel to appear in the Court on their behalf, on each and every date of hearing; such petitioners not disputing their identity; no adjournment being asked without any justifiable reason. The trial Court may direct such petitioners to appear in the Court, if their presence is found necessary for any purpose.
