Present appeal pertains to the year 1997. Vide order dated 02.09.2024 counsel for the appellant had pleaded no instructions in the matter and accordingly notice was issued to the appellant. As per office report, proprietor of the appellant-firm is reported to have died and the appellant-firm has since been lying closed. There is no other address of the appellant available except for the one as mentioned in the memo of parties as well as judgments of the Courts.

In view of the above, this Court is left with no other option but to dismiss the present appeal for non-prosecution. 3.

Dismissed for non-prosecution with liberty to revive in any case anything survives in the matter. Pending application, if any, also stands disposed off.
