The petitioners through instant petition under Article 226/227 of the Constitution of India are seeking setting aside of order dated 15.07.2002 to the extent they have been transferred from Intelligence Wing to PAP/IRB without their consent. They are further seeking direction to respondent No.1 to take final decision on the proposal of respondents No.2 and 3 to declare Intelligence Wing as separate cadre and permit the petitioners to continue in Intelligence Wing. The petitioners joined Intelligence Wing of Punjab Police in 1992 as Constable Drivers. They were sent on deputation to State Transport Department from where they were assigned duties of Drivers of official cars of VIPs. They were not imparted initial recruit training as imparted to Constable of Punjab Police. The respondent decided to depute petitioners for training. It was also decided to send them from Intelligence Wing to PAP. It amounted to change of their cadre from Constable Drivers of Intelligence Wing to Constables of PAP/IRP. Notice of motion was issued on 21.01.2003, however, impugned order was not stayed.

Learned senior counsel for the petitioner submits that he has no contact with the petitioners. He may be granted liberty to move an appropriate application within three months, if cause survives. 4.

Dismissed with aforesaid liberty.
