(Oral) The instant petition has been filed under Section 438 of Cr.P.C., for grant of anticipatory bail to the petitioners in case FIR No.209 dated 15.06.2018, under Sections 323, 324, 34 & 506 IPC, registered at Police Station Chandhut, District Palwal.

Learned counsel for the petitioners contends that the matter has been settled amongst themselves amicably and on the direction of this Court, have joined the investigation. It is also contended that nothing is to be recovered from them.

Per contra, learned State counsel, on instructions from the Investigating Officer, submits that petitioners have joined the investigation SATYAWAN 2018.12.05 17:05 I attest to the accuracy and integrity of this document

CRM-M-27968-2018 -2and they are not required for the custodial interrogation. Learned counsel for the complainant submits that he has no objection in case the interim protection allowed to the petitioners herein is made absolute.

In view of the facts that the petitioners are not required for custodial interrogation, have joined the investigation and the matter has been settled amongst themselves, without commenting on the merits of the case, the petition is allowed and order dated 09.07.2018 granting interim bail to the petitioners is made absolute subject to the conditions laid down in Section 438 Sub Section 2 Clauses (i)(ii) and (iii) of the Code of Criminal Procedure.
