(ORAL) By order dated 09.07.2018, this Court was pleased to pass the following order :- "This petition has been filed for grant of anticipatory bail in the FIR No. 477 dated 28.06.2014 registered under Sections 363, 366-A of IPC, registered at Police Station Sadar Karnal, District Karnal.

It is contended that by order dated 08.08.2017, proceedings in the said FIR are stayed. The petitioner herein has been declared as proclaimed offender by order dated 04.12.2015 while also contending that the petitioner had approached this Court by way of CRM-M-1217-2017 seeking protection at the hands of the family members of his wife and which protection has been allowed while noting that the parties had married and out of which wedlock, a child had been born.

In the meantime, the arrest of the petitioner is stayed for a period of one week and he is directed to appear before the trial Court within a period of seven days and in the event of his appearance, trial Court shall admit him on interim bail on furnishing requisite bail bonds/surety bonds subject to its satisfaction.

Learned counsel for the petitioner submits that in compliance with the above order, the petitioner has surrendered before the Court below and has been admitted to bail to its satisfaction. Learned counsel for the respondent-State, on instructions from the Investigating Officer, confirms the factum of surrender by the petitioner and grant of bail.

Since the petitioner has surrendered before the Court below and has been admitted to bail, the petition is allowed and interim order dated 09.07.2018 is hereby made absolute subject to the condition that the petitioner will not tamper with evidence or hamper the investigation; will not leave India without permission of the Court and will comply with the conditions contained in Section 438(2) Cr.P.C. 26.09.2018 (JAISHREE THAKUR) Satyawan JUDGE Whether speaking/reasoned Yes.
