M.M.S. BEDI, J (ORAL) For having been found in possession of 1 kg 300 gms. of Charas, the petitioner has been in custody w.e.f. 22.1.2014. Counsel for the petitioner submits that statutory provisions of law have not been complied with and the recovery effected is marginally higher than the commercial quantity provided i.e., 1 kg of Charas.
It has been informed that out of ten witnesses cited by the prosecution, five witnesses have already been examined. Taking into consideration the quantity; the period of detention suffered by the petitioner and the stage of the trial, this petition is disposed of with a direction that in case the prosecution agency is not able to produce the material witnesses within a period of five months after the next date of hearing and the trial is not RAJ KUMAR ARORA 2015.02.05 17:29 I attest to the accuracy and integrity of this document
