Based thereupon, it has been submitted that the CCTV footage shows that a person who was sitting on a motorcycle at Bhikiwind, Bus stand and speaking on a mobile phone was approached by people in civil dress. They arrested him and subsequently, a person in uniform drove the motorcycle away. Identification is not possible due to the poor quality of the video.

Learned counsel for the petitioner submits that the CCTV footage conclusively shows that the brother of the petitioner was arrested at Bhikiwind bus-stand. The petitioner was not arrested at the spot and has been nominated as an accused only on the disclosure statement made by the co-accused. Pursuant to the order passed by this Court, the petitioner has joined investigation and is cooperating therewith. Thus, the interim order dated 29.03.2023 may be made absolute.

Learned State counsel does not dispute that the petitioner has joined investigation and is cooperating therewith. 5.

Thus, the petition is allowed and the interim bail granted to the petitioner vide order dated 29.03.2023, is made absolute subject to compliance of conditions enshrined under Section 438(2) of the Code of Criminal Procedure, 1973, by him.
