Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in complaint case under Sections 354 and 452 IPC titled as 'Anu Soni vs. Ramesh Mehta' pending in the Court of learned Judicial Magistrate, Anandpur Sahib.

Notice of motion was issued and learned State counsel as well as learned counsel for respondent No.2 appeared and contested the petition.

I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. From the record, I find that it is a complaint case. The VINEET GULATI 2015.09.19 14:38 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-27002 of 2015 -2petitioner is not required for any investigation or interrogation purposes nor anything is to be recovered from him. He is only to appear before the trial Court and to face the trial. As per order dated 14.08.2015, the petitioner has appeared before learned SDJM, Anandpur Sahib and has been released on interim bail. The trial of the case will take long time. No useful purpose will be served by sending the petitioner to custody. Keeping in view the facts and circumstances of the case and without discussing the merits of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where the petitioner is entitled to benefit of grant of anticipatory bail. Therefore, the present petition is accepted and the order dated 14.08.2015 is made absolute.
