RAJESH BHARDWAJ, J.(ORAL) Prayer in the present petition is for issuance of direction to the respondents to allow the petitioner's party, i.e. Shiromani Akali Dal (Amritsar) to hold a conference on the occasion of Hola Mohalla and provide adequate protection etc., as prayed for in his representation, dated 23.02.2024, Annexure P-1.

It has been contended by learned counsel for the petitioner that a Conference is to be held on 25.03.2024 and for holding the same, the petitioner has already filed representation, dated 23.02.2024, Annexure P-1, before respondent No.3-Deputy Commissioner, Ropar, but the same has not been replied till date.

CWP-7259-2024 -2code of conduct is already in operation and even if the respondents had given the permission earlier, the same would have been deemed to be cancelled by the Election Commission of India. He submits that the petitioner, if so desires, may approach the Election Commission of India for seeking the necessary permission, as prayed for, in this petition. Learned counsel for the petitioner, however, submits that no decision on the representation filed by the petitioner has been taken by respondent No.3-Deputy Commissioner, Ropar.

After hearing counsel for the parties, it is apparent that a code of conduct is in operation after promulgation of the Lok Sabha Elections, thus, there is no dispute regarding the contention of learned State counsel that code of conduct is in operation. However, on the request of counsel for the petitioner, respondent No.3-Deputy Commissioner, Ropar, is directed to pass an order, on the representation, dated 23.02.2024, Annexure P-1, filed by the petitioner in accordance with law, on or before 24.03.2024. Disposed of.
