Prayer in the petition is for issuing direction to respondents No.2 and 3 to protect the life and liberty of the petitioner and his family members at the hands of respondents No.4 to 6. Reply by way of affidavit of Mr. Jaswinder Singh, PPS, Assistant Commissioner of Police (Crime), Ludhiana has been filed. In the preliminary submissions, it is submitted as under :- "1.
That there is absolutely no threat to the life and liberty of the petitioner. However, on the statement of the petitioner, FIR No.207 dated 21.09.2014 under Sections 452/427/506 IPC, P.S. Sarabha Nagar, Ludhiana has been registered against respondent No.6 for tress-passing the house of the petitioner, threatening him and for damaging the CCTV camera of VIJAY ASIJA 2015.03.25 16:20 I attest to the accuracy and integrity of this document
Crl. Misc. No. M-27106 of 2014 -2the house of the petitioner. However, further investigation is still being conducted and after completion of the same, Challan/Final Report under Section 173 Cr.P.C. will be prepared accordingly. Hence the preent petition is liable to be dismissed on this ground alone."
Learned State counsel on instructions from ASI Gurmukh Singh states that there is no threat to the life and liberty of the petitioner. On the statement of the petitioner, FIR No.207 dated 21.09.2014 under Sections 452/427/506 IPC, P.S. Sarabha Nagar, Ludhiana has been registered against respondent No.6 and the matter is under investigation. Considering the fact that respondent-State has acted on the statement of the petitioner regarding threat perception, no action is called for, particularly when the police is pursuing the matter and the same is under investigation. However, in case of receiving any fresh threat perception, the petitioner may approach respondent No.2-Commissioner of Police, Ludhiana, who shall consider the request of the petitioner in accordance with law.
The petition is disposed of.
