******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.140 dated 16.08.2016 registered for offences punishable under Sections 193, 419, 420, 465, 466, 467, 468, 471 read with Section 120-B of Indian Penal Code (for short, "IPC") at Police Station Division no. 5 Ludhiana, District Ludhiana.

Notice of motion.
On asking of the court, Mr. Ajay Pal Singh Gill, DAG, Punjab, DAG, Punjab, who is present in the Court accepts notice and submits that intimation by Registry informing of fixation of the petition has already been received and record of the case is available with him. The instant FIR was registered on the complaint of Ajaypal Singh relating to property of his father, Wazir Singh. Allegation against the petitioner and other co-accused are that the will of Wazir Singh was forged in favour of Surjit Singh son of Karnail Singh on the basis of which Jitender Kumar 2017.08.08 17:46 I attest to the accuracy and integrity of this document CHANDIGARH
CRM-M-27076 of 2017 -2mutation no. 7846 dated 20.05.2016 was got entered and sanctioned. Allegation against the petitioner is that she had given an affidavit at the time of mutation posing herself to be sister of Wazir Singh and the affidavit bears her photograph.
Learned State counsel submits that specimen signatures of petitioner and her signatures on affidavit have been sent for report to FSL, which is still awaited.
The petitioner was arrested on 21.02.2017 and the challan has been presented in Court. Her role in the conspiracy is based on report of FSL, which is still awaited.
In view of above but without expressing any opinion on merits of the case and keeping in view the fact that conclusion of trial will take considerably long time, the present petition is allowed. Petitioner-Paramjit Kaur is ordered to be released on regular bail on furnishing bail bond and surety bond to the satisfaction of concerned trial Court/Chief Judicial Magistrate/Duty Magistrate, subject to following terms:- (a) The petitioner shall comply with the conditions mentioned in Section 437(3) Cr.P.C.
(b) In the event of her absence on any date of hearing, the benefit of bail allowed to the petitioner shall stand withdrawn. The trial Court shall be competent to cancel her bail bond and surety bond and proceed to procure her presence in accordance with law. In that eventuality the petitioner shall have to apply for bail afresh. (c) She shall not leave the country without the previous permission of the Court.
