Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in complaint case No.723/23.12.2013 under sections 323, 324, 326 and 506 IPC read with Section 34 IPC. Notice of motion was issued and learned State counsel appeared and contested the petition. However, none appeared on behalf of respondent No.2 despite service.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that this is a complaint case in which accused have been summoned. CRM No.M-27045 of 2015 -2for any investigation or interrogation purposes. Nothing is to be recovered from him. The petitioner is only to appear in the Court and to face trial. The trial of the case will take long time. No useful purpose will be served by sending the petitioner to custody. The petitioner has already surrendered before the trial Court and has been released on interim bail by the trial Court.

Keeping in view the facts and circumstances of the case and without discussing the merits of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case where the petitioner is entitled to benefit of anticipatory bail. Therefore, the present petition is allowed. The order dated 20.08.2015 granting interim bail to the petitioner is made absolute.
