M.M.S. BEDI, J. (ORAL) Petitioner is alleged to have caused fracture with an iron pipe on the right parietal and temporal bones on the person of Dinesh who along with other eye witnesses stand already examined. It is not out of place to observe here that the petitioner has been granted concession of bail in this case but on the basis of the medical report that the injuries attributed are dangerous to life, he was re-arrested.

Taking into consideration the fact that the material witnesses stand examined and the chance of tampering with the evidence being remote, the petitioner can be granted concession of bail.

The petition is allowed. It is ordered that the petitioner will be released on bail on his furnishing bail bonds/surety

CRM-M-27048-2015 (O&M) bonds to the satisfaction of the trial Court subject to the condition that he will not commit the similar offence of which he is accused of during the pendency of the trial.
