ARVIND SINGH SANGWAN J. (Oral) Counsel for the petitioner seeks permission to withdraw the present revision petition, however, restricts her argument limited to the extent that since the petitioner is a lady her personal appearance before the trial Court be exempted during the course of trial. Dismissed as withdrawn. However, the personal appearance of the petitioner shall remain exempted before the trial subject to the following conditions:

i.

her personal appearance shall remain exempted subject to furnishing an undertaking before the trial Court that she shall be represented through her counsel; ii.

she shall not delay/stall the proceedings of the trial; she shall not dispute her identity as accused; iii.

she shall have no objection if the prosecution evidence is recorded in her absence but in the presence of her counsel;

iv.

she shall appear before the trial Court as and when required by the trial Court and other condition which the trial Court may impose.

However, it will be open for the trial Court to recall the order granting exemption from personal appearance at any stage and the petitioner shall appear before the trial Court on any substantive date when her personal appearance is required.
