CRM-M-27133-2017 Learned State counsel submits that evidence of the prosecution is almost over. One of the recovery witness has since died and prosecution has moved an application under Section 311 Cr.P.C. for summoning of constable Harinder Singh to depose in this case which is pending as the petitioner has not filed any reply so far.

Learned counsel for the petitioner seeks permission to withdraw the petition with requests that the trial Court be directed to decide Jyoti 2017.10.31 14:05 I attest to the accuracy and authenticity of this document

In view of submission of learned counsel for the petitioner, this petition is dismissed as withdrawn with liberty to file fresh one if need so arise.
