(Oral) Prayer in this petition is for grant of anticipatory bail to the petitioner, in a case arising out of FIR No.85, dated 01.06.2014, registered at Police Station Kotwali, Kapurthala, Distt. Kapurthala, who has been booked for having committed the offences punishable under Sections 379 IPC.
In compliance of order dated 22.12.2014, an affidavit of Lakhvinder Singh has been filed in the Court today, which is taken on record. As per affidavit, the petitioner had joined the investigation on 31.12.2014 and handed over the stolen articles i.e mobile phone and CD player, which were taken into possession. Crl. Misc. No. M-27187 of 2014 (O&M) -2further gave the statements that he was out of station and that is why he could not join the investigation on 04.10.2014 (R-1).
The recovery has been effected from the petitioner and in compliance of order dated 12.08.2014, he has joined the investigation on 31.12.2014, at this stage, custodial interrogation of the petitioner is not required. In view of the totality of the facts and circumstances of the case, order dated 12.08.2014 passed by this Court whereby the ad-interim anticipatory bail was granted to the petitioner is made absolute. The petitioner shall continue to join the investigation as and when required to do so and abide by all the conditions as envisaged under Section 438 (2) Cr.P.C However, the petitioner is at liberty to file fresh bail bonds after presentation of the challan.
