Vide order dated 08.01.2024 notice was issued to the sole appellant. As per the service report, notice issued to the appellant has been received back with the report that there are three persons by the name of Gurcharan Singh in the village, out of which two have died and the person who is alive is not the appellant in this appeal. This is the only address which was given in the memo of parties and in the judgments and decrees passed by both the Courts. None has put in appearance on behalf of the appellant. In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution. 2.

Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
