Petitioner has impugned order dated 15.07.2015 passed by Additional Sessions Judge, Rewari whereby it has been directed that two effective opportunities be afforded to the prosecution to examine prosecution witness namely Rupesh Yadav, Verterinary Surgeon. Petitioner is aggrieved by order on the ground that trial of the case has already culminated.

I have heard learned counsel for the petitioner. It appears that FIR was lodged against him on the complaint of one Ram Niwas. He alleged that accused entered his filed and killed his mule using an axe. Investigation ensued and challan was filed. Ultimately prosecution evidence was closed by order dated 07.06.2011 passed by ACJM, Rewari. Respondent no. 2 preferred revision petition against this order. The court, however, came to the conclusion that two effective opportunities were required to be granted to the prosecution to examine the Veterinary Surgeon. I find no infirmity with the order. The matter has been pending since the year 2007. Any further delay would not be in the interest of justice. Dismissed.
