Petitioners along with their co-accused had faced the trial qua commission of offence punishable under Section 452, 326, 325, 324, 323 read with Section 34 of the Indian Penal Code, 1860 ('IPC' for short) in FIR No. 144 dated 24.10.1991, registered at Police Station Shri Hargobindpur. Trial Court vide judgment/order dated 6.10.2000/11.10.2000 ordered the conviction and sentence of the petitioners and their co-accused qua commission of offence punishable under Section 452, 326, 324, 323 read with Section 34 IPC. However, they were ordered to be acquitted of the charge framed against them under Section 325 IPC. Aggrieved against the judgment/order of their conviction and sentence, petitioners along with their co-accused preferred an appeal and the same was dismissed by the Appellate Court vide order dated 21.2.2005. However, the sentence awarded by the Trial Court to the petitioners, was reduced by the Appellate Court. None has appeared on behalf of the petitioners. I have gone through the record of the Trial Court carefully. During trial, petitioners had remained in custody for a long period i.e. more than the sentence qua imprisonment awarded to them. Thus, the petitioners have already undergone the sentence qua imprisonment awarded to them.
Therefore, this petition has been rendered infructuous and is disposed of accordingly.
