Mr. Gaurav Bansal, Assistant Advocate General, Haryana *** This petition for regular bail has been filed by petitioner Shravan, an accused in F.I.R. No. 105 dated 3.4.2017 for offences under Sections 457 and 380 of the Indian Penal Code registered with Police Station Tosham, District Bhiwani.
Briefly stated the facts of the case as per prosecution version are that a theft having took place at Government Senior Secondary School, Miran on 3.4.2017 at mid night, as a result of which 22 LED, 2 CPUs, 1 Computing Device etc. were stolen.
The accused was arrested in this case on 28.4.2017. During the course of interrogation he suffered disclosure statement and got recovered 11 LEDs HCL and 1 CPU HCL from his house.
After completion of investigation, challan against the accused was filed, which is pending before JMIC, Tosham. The petitioner has moved an application in the Court below but Parvinder Singh 2017.12.15 17:24 I attest to the accuracy and integrity of this document Chandigarh
CRM-M No. 27172 of 2017 was unsuccessful, as such he has approached this Court praying for grant of similar relief. His request is being opposed by the learned State counsel and learned counsel for the complainant.
I have heard learned counsel for the petitioner, learned State counsel besides going through the record.
The accused is not mentioned in the F.I.R.. The recovery has also been effected from him. The offences are triable by the Court of learned Magistrate. The co-accused has already been granted bail by the Court of Sessions.
The trial is likely to take some time, as such without going into the merits of the case, the present petition is allowed. The petitioner is ordered to be released on bail on furnishing bail bond and surety bond to the satisfaction of the learned trial Court/CJM/Duty Magistrate, Tosham, District Bhiwani subject to the following conditions : - (i) He shall appear in the Court on each and every date of hearing.
(ii) He shall not give any threat or intimidation to the prosecution witnesses.
(iii) He shall not leave India without prior permission of the Court.
In addition to that the trial Court may impose any term and condition found suitable to ensure that the petitioner does not abscond and interfere in the trial.
