*** ARUN MONGA, J. (ORAL) Petition was filed in the year 1996, inter alia, seeking issuance of a writ in the nature of mandamus directing the respondents to promote the backward class candidate against the post Nos. 10,16, 22, 32, 46, 56, 70,76 and 86 and so on and to consider the case of the petitioner for promotion to the post of Forest Ranger.

Petition was admitted on 10.11.1997.

When called out for hearing, there is no representation on behalf of the petitioner. It seems that by sheer effluxion of time and pendency of the writ petition for more than 25 years before this Court, either it has been rendered infructuous or even otherwise the petitioner seems to have lost interest in pursuing the same.

In any case, it appears that even on merits claim of the petitioner is not admissible in view of the following stand taken in para 3 of the preliminary submission, which is reproduced herein for ready reference- "3.

That the present writ petition does not lie as alleged by the petitioner, 10% seats are reserved for Back-ward class category. From 9/2/79, 152 vacancies of Forest Rangers were filled in the Forest Department. As per 10%, 15 vacancies of Forest Rangers are meant for Backward Class category. Already 16 persons are working as Forest Rangers in the Forest Department of the Backward class category, hence no post of Backward class category for Forest Rangers is lying vacant in the Forest Department."
