Petitioners have filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.32 dated 13.03.2017 under Section 406 IPC, registered at Police Station City Jalalabad, District Fazilka.

I have heard learned counsel for the petitioner and have gone through the record.

From the record, I find that FIR in the present case has been got registered by Punjab State Civil Supplies Corporation Ltd. As per the allegations, present petitioners constituted a firm under the name and style of M/s Surya Industries, Tiwana Road, Jalalabad. An agreement was executed. 212833 bags of paddy weighing 35 kgs. each totalling to 74491.55 quintals were delivered to the accused. CRM No.M-27185 of 2017 -2accused to other district. After transfer of paddy, net storage of paddy was 199083 bags. As per physical verification on 25.01.2015, shortage of 29203 bags weighing 10221.05 quintals was found in the mill and accused misappropriated the paddy.

Keeping in view the serious allegations against the petitioners that they misappropriated such a huge amount of paddy, I do not find it a fit case where petitioners are entitled to benefit of anticipatory bail. Therefore, finding no merit in the present petition, the same is dismissed.
