CRM-M-14420-2020 The petitioner prays for grant of regular bail pending trial in a criminal case arising from FIR No. 70 dated 20.03.2020, registered under Section 22 & 29 of the Narcotic Drugs & Psychotropic Substances Act, 1985 (hereinafter referred to as "the 1985 Act"), at Police Station Bhiwanigarh, District Sangrur.
As per the case of the prosecution, on the basis of a secret information, Harmail Singh, Mukesh Kumar and Saranjeet Singh were apprehended with 30,900 intoxicant tablets of Tramadol Hydrochloride and 4,000 intoxicant tablets of Alprazolam. The petitioner has been nominated as an accused being supplier of the aforesaid prohibited intoxicating tablets. Criminal Misc. No. M- 14420 of 2020 (O&M) Learned counsel for the petitioner contends that the petitioner is entitled to regular bail till the report from the Forensic Science Laboratory is received.
On the other hand, Ms. Samina Dhir, Deputy Advocate General, Punjab, has submitted that the report from the Forensic Science Laboratory after analysis has been received and the police is likely to present the challan (the final report under Section 173 Cr.P.C.) shortly in the Court. Learned State counsel has also informed that the petitioner does not have clean criminal antecedents as she is also an accused in two more FIRs under the 1985 Act.
Keeping in view the aforesaid facts, this Court is not inclined to grant the benefit of regular bail to the petitioner. Hence, the present petition is dismissed.
