(Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No. 53 dated 25.07.2015, registered at Police Station Kheri Gandian, District Patiala, who has been booked for having committed the offence punishable under Sections 363/366-A/120 (376 IPC added later on) and Section 7/8 of POCO Act. This Court vide order dated 01.09.2016 released the petitioner on bail as Bhawan who was present in the Court stated that she was happily living with the petitioner and his mother and wants to go with them. Mother of the petitioner also stated that she is ready to perform marriage of her son with Bhawna. Further as per P.W.7, the prosecutrix made a statement in favour of petitioner and his mother.

No. M-28077 of 2016 -2Thereafter, on 05.10.2016, order dated 01.09.2016 was modified by giving liberty to Jaspal Kaur to take Bhawna from Gandhi Nari Niketan, Kapurthala Chownk, Jalandhar to her house. Thereafter, on 21.10.2016, learned counsel for the complainant has given affidavit of the daughter of the complainant, which was handed over to I.O. Learned counsel further submitted that the daughter of the complainant has a CD also which shows that the petitioner and other accused are forcing the daughter of the complainant to indulge in immoral activities.

This Court directed the learned State counsel to verify this fact and file status report.

Today, learned State counsel filed the status report stating therein that the statement of Bhawna was recorded on 05.11.2016, who stated that she is not in possession of any CD etc of wrong acts done. She is residing with her husband and mother-in-law properly. She has married to Veerpal Singh on 13.10.2016 (R-1). Further residents of the mohalla/neighbours of Jaspal Kaur gave their joint statement to the effect that she is not running any illegal activities in the Mohalla and Veerpal Singh has married to Bhawna on 13.10.2016.

Bhawna, who is present in the Court today along with petitioner and her mother, stated that she is living happily with her husband and mother-in-law and she further stated that she made an attempt to meet her father today, who was present in the morning but he was not talking to her properly.

Crl. Misc. No. M-28077 of 2016 -3Keeping in view the above fact, order dated 01.09.2016 is made absolute and no further orders are required to be passed in the present petition.

Disposed of.
