(ORAL) In the present case, the grievance which is being raised by the petitioner is that he retired from service on 31.05.2018 and even after an expiry of approximatley 10 months, all the retiral benefits, for which he is entitled for, have not been released.

As per the averments made in the writ petition, petitioner was entitled for an amount of `18 lakhs (approximately) as retiral benefits, out of which, only a sum of `5 lakhs has been paid to him till date. Counsel for the petitioner states that there is no impediment in the release of the pensionary benefits as there is no proceeding pending against the petitioner which would entitle the respondents to withhold the same in any manner.

CWP-8578-2019 -2respondents with a legal notice on 19.02.2019 (Annexure P-2), which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice.

In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioners, the respondents are directed to decide the legal notice dated 19.02.2019 (Annexure P-2) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to him within a period of next three months.

Present writ petition stands disposed of.
