The petitioner is seeking regular bail in FIR No.38 dated 01.03.2015 registered under Sections 354 read with Section 120/B and Section 8 of the POCSO Act (added later on) at Police Station Dera Bassi, District S.A.S. Nagar.

Counsel for the petitioner contends that the complainant is not appearing for her statement and though she had been bound down for 16.10.2015 she failed to appear and bailable warrants were issued which were executed and she again failed to appear and now non/bailable warrants have been issued against her and she is evading them. The FIR in this case is under Section 354. In view of the above position, without commenting upon the merits of the case, the petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal and surety bonds to the satisfaction of trial Court.
