**** HARSIMRAN SINGH SETHI , J. (ORAL) Counsel for the petitioner states that the petitioner retired on 28.02.2018. On the said date, there was an FIR No.126 dated 17.06.2003, which was pending against the petitioner.

Counsel for the petitioner further states that after the retirement of the petitioner, he was acquitted in respect of the said FIR on 14.03.2018 and thereafter, there is no impediment in the release of the pensionary benefits of the petitioner. Further, though the petitioner has already informed about the said development to the respondents, vide letter dated 06.01.2019 (Annexure P-2), but no action has been taken by the respondents for the grant of the said benefit to the petitioner and it is very difficulty for him to survive in these hard days without the release of the retiral benefits.

CWP-8576-2019 -2Counsel for the petitioner states that the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said representation/letter dated 06.01.2019 (Annexure P-2) by passing a speaking order.

In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the representation/letter dated 06.01.2019 (Annexure P-2) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to him within a period of next three months.

Present writ petition stands disposed of.
